Terms of Service

These Terms of Service ("Terms") govern your access to and use of PULSE, a Whatnot market-intelligence service ("PULSE", "we", "us", or "the Service") operated by Zachary Alexander. By creating an account, paying for a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What PULSE is

PULSE collects and analyzes publicly available data about live shows on the Whatnot platform and presents aggregated insights (category trends, seller activity, timing recommendations, and similar analytics). PULSE is an independent product and is not affiliated with, endorsed by, or sponsored by Whatnot, Inc. "Whatnot" is a trademark of its respective owner.

2. Accounts and API keys

Some features require an account and an API key. You are responsible for keeping your API key confidential and for all activity that occurs under it. The key is shown to you once; if you lose it you can rotate it from within the Service or contact us at [email protected]. You must provide accurate account information and use a real, non-disposable email address.

3. Subscriptions, trials, and billing

Paid plans ("Pro") are billed in advance on a recurring basis through our payment processor, Stripe. New subscriptions may include a free trial; at the end of the trial your payment method is charged automatically unless you cancel beforehand. You authorize us and Stripe to charge your payment method for the applicable fees. Pricing is shown at checkout. See our Refund & Cancellation Policy for cancellation and refund terms.

Subscriptions purchased in the PULSE iOS app are different. They are sold and processed by Apple, not by us, and Stripe is not involved. Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically, and your Apple ID is charged within 24 hours before the end of the current period, unless auto-renew is turned off at least 24 hours before then. The price and subscription length are shown in the app before you buy. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Manage or cancel an App Store subscription in your device settings under your name → Subscriptions; we cannot cancel or refund an Apple purchase on your behalf. Apple's standard licence terms also apply to that purchase.

We may rate-limit, suspend, or terminate accounts that violate these Terms or that we reasonably believe are abusive or fraudulent.

5. Data and accuracy

PULSE's analytics are derived from third-party data and statistical estimates. They are provided for informational purposes only and may be incomplete, delayed, or inaccurate. They are not financial, business, or professional advice, and you are solely responsible for any decisions you make based on them.

6. Privacy

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms.

7. Intellectual property

The Service, its software, and its presentation are owned by PULSE and protected by applicable law. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own business purposes while your account is in good standing.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that the data will be accurate or complete.

9. Limitation of liability

To the maximum extent permitted by law, PULSE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be reflected by updating the "Last updated" date above; continued use after a change constitutes acceptance.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability) will survive.
